MINUTES OF THE MEETING HELD ON Monday 9 October 2023

Present:         Councillors – Cllr D Spence (Chairman), Cllr A Ellis, Cllr Mrs S Swires and

Cllr M David.

4        Approval of previous minutes –

 

Approval of the Minutes of the Parish Council Meeting held on 11 September 2023 was proposed by Cllr Mrs S Swires, seconded by Cllr Ellis and signed by the Chairman.

 

5        Urgent Business          The Defibrillator for the Squinting Cat to be collected

ready for installation.

Instructions for the regular maintenance to be obtained for

use by the replacement custodian of the Smiths Arms

defibrillator.

 

                                                  Grants – Working with Organisations          Ongoing.

 

                                                  Bench – siting of, on Otley Road.          Awaiting delivery

of bench (Nov 2023) and contact with the

site management.

 

                                                  Notice Board - Grant application refused. Apply to Knabb’s

Ridge.

 

Commuted Sums – Approx £41,000 to be spent before

6       Finances

 

- The bank balances at 9 October 2023 were reported to the Parish

Council:

     Second half of precept received.

 

Clerk to investigate the possibility of a ‘Debit Card’ for some payments. – ongoing.

         

Bank Mandate has been passed to HSBC.

 

     Payment of Clerk’s Expenses £291.57 Approved by Cllrs Spence and Ellis.

 

NJC pay award not yet approved - possible increase of £275 pa to Clerk’s Salary.

 

     September quarter’s Audit - Cllr Spence and Cllr Mrs S Swires completed and

approved the Internal Audit.

 

7            North Yorkshire Councillor        Cllr Hull to be asked for any progress re hedgerows

and cricket footpath.

                20/01706/EIAMAJ – Amended

Outline application with access off Whinney Lane for the erection of 230 dwellings, school etc – Amended details and updated environmental statement (Banks Property Ltd)

 

The Parish Council wishes to object to this application based on the issues and concerns raised below. The planning decision should not be made until the Parameter Plan is in place, reviewed and agreed by the planning committee of North Yorkshire Council and the affected Parish Councils.

Traffic and Transport

· Lack of an integrated plan featuring suitable transport links.

· No planned road or pavement improvements for Whinney Lane or Lady Lane.

· The traffic assessments are not based on current usage; the Jacob’s Report is 5 years out of date.

· Whinney Lane, Lady Lane and Hill Top Lane have little capacity to accommodate increased traffic flows at the levels predicted.

· The Whinney Lane/Pannal Ash roundabout currently suffers from congestion at peak periods and there is no proposal to include footpaths and cycle lanes on Lady Lane or Hill Top Lane, despite there being a national drive to reduce trips by car to induce trips on foot and cycle.

· In the YWG Castle Hill West Transport Assessment, Section 9.10 states that “residual traffic impacts are not severe”; this is incorrect.

· No consideration has been given to the wider aspects of the traffic flow to/from the immediate sites under consideration, how it will affect the villages of Beckwithshaw, Pannal, Burn Bridge and North Rigton, or its subsequent impact on access into Harrogate via Pannal Ash and Otley Road.

· Section 8.5 of the YWG Assessment states that “At the Pannal Ash Roundabout, Otley Road/ Pannal Ash Road/ Cold Bath Signals and the Prince of Wales Roundabout the effect of development is to increase queues and delays to some extent, but that increase is not considered to be severe.” The Parish Council does not believe this to be an accurate assessment.

· The existing network is insufficient to carry current loads and yet Section 7.24 of the YWG Assessment states that overall the impact of development generated traffic is low - compared to committed development and traffic growth - and the impact is not severe.

· No capacity to widen Whinney Lane due to existing housing.

Water Supply and Drainage

· Negative impact on the supply/pressure of the local water supply.

· No design data to prove that the proposed surface water drainage solution is adequate and based on agricultural land flooding history, rather than the output from a developed site with its inherent hard surfacing.

Sustainability

· Lack of sustainable housing.

· Lack of a developed approach to the design of the properties with their impact on global warming.

Education Provision

· Lack of holistic planning. Included in the three large sites of the Western Arc Development (Windmill Farm, Whinney Lane West and Gladmans) , provision has been made for 3 Primary Schools but no provision for Secondary Education, indicating that all those pupils of secondary age would need transportation which would further add to the burden of the transport requirement/network.

· There is no certainty offered that the capacity of the proposed new schools will be available to meet demand in anticipation of the occupation of these properties.

 

 

Community Facilities

· Local Retail.

· Medical Facilities.

· Community Centre.

· Transport Hub.

· No defined Play Areas.

· No defined Sports Areas.

· No indication of ratio of Social Housing.

· No indication of a management plan for the ongoing maintenance of public spaces.

Ecology

· No assurance that the proposed housing will relate to its rural setting with the use of materials sympathetic to the rural location.

· Absence of proposed climate change initiatives.

· No provision is given to protect existing and future wildlife habitats.

· Protection is required for the existing trees, hedgerows and Public Footpaths.

          Extension to residential curtilage at Bradbury House, Moor Park (Mrs D Manton)

 

 

The Parish council does not object or support the application but wishes to make comments or seek safeguards as set out below:-

 

That the domestic curtilage does not include the existing wooded areas (details stated by  the applicant), thus ensuring that there will be no need to secure the preservation of these trees.

 

                   

9        Local Plan   Consultations still ongoing.          

 

10       Traffic and Highways       Another request for the double yellow lines outside the

Village Hall be replaced was to be made, but new

notification dates now 11 and 12 October 2023.

11       Copse and Grass cutting  An autumnal review is needed of work required.

 

12       Correspondence              A letter from the Executive Headteacher of Beckwithshaw

CP School asking if there was anyone who would like to

be a Federation Foundation Governor. Reply that all our

Councillors are fully committed with Parish Council

Activities, but should anyone come forward we would

inform her.

 

13       Councillors Questions/Comments

 

                                                  Everyone was reminded to get their Covid jabs.

 

                                                  It was reported that there seems to be a problem along

Beckwith Head Road with Horse and Dog Droppings.
